论执行回转制度

摘    要

执行回转制度属于强制执行制度，是救济制度中的1种方法，是1种判决书下达后的.救济方法。执行回转仍然是1种执行程序，也就是说执行机关行使强制执行权的1种表现，执行权的行使如果没有确定性和权威性，显然会进1步导致执行难问题的恶化。我国目前在强制执行制度方面最大的问题就是“执行难”问题。执行回转制度是对当事人权利的救济。本文具体阐述了执行回转制度的具体内容、执行回转与既判力和我国现存的执行难问题与执行回转的关系。

ABSTRACT
Recovery of execution is a part of Enforcement System, its not only a method in the Remedy System, but also a remedy method after the judgement s release rtheless, recovery of execution can be counted as a Enforcement process as well, which is a expression of the law-related governments to finish the Administrative Execution. If the fulfillment of execution doesnt have its own certainty and authority. Obviously it will leads to a worse condition in the  "Hard Enforcement". The biggest problem regarding Enforcement System in our country is "Hard Enforcement". Recovery of execution is a relief for the right of related party. This article explains the details of recovery of execution, recovery of execution and Adjudged Force, the existing problem of "Hard Enforcement" in our country, and its relationship with recovery of execution.
